Using emails or other electronic communications in debt collection is cost-effective and convenient, but according to a recent 7th Circuit decision, delivering federal Fair Debt Collection Practices Act disclosures using a hyperlink means trouble. And the FDCPA is not the only source of regulation of electronic communications in debt collection. This presentation examines the impact on emails from the 7th Circuit's recent decision in Lavallee, the proposed FDCPA rules concerning electronic communications, state regulation and the E-Sign Act.
